TERMS AND CONDITIONS OF SALE – THE GARDEN ARTS
Article 1 – Legal Information
These Terms and Conditions of Sale apply to all orders placed through the commercial area of The Garden Arts, a website owned and operated by Lézard du Jardin, owner of the website www.lezarddujardin.fr.
Lézard du Jardin reserves the right to amend or modify these Terms and Conditions of Sale at any time.
In the event of modification, the Terms and Conditions applicable to each order shall be those in force on the date of the order.
In accordance with applicable law, you have the right to access, modify, rectify, and delete personal data concerning you, as provided by Article 34 of the French “Data Protection Act” of 6 January 1978, as amended.

Article 2 – Acceptance of the Terms
The customer acknowledges having read, at the time of placing the order, the specific conditions of sale displayed on screen and expressly accepts them without reservation.
These Terms and Conditions govern the contractual relationship between Lézard du Jardin and the customer, both parties accepting them without reservation. They shall prevail over any other terms contained in any other document unless expressly agreed otherwise in writing.
Article 3 – Products
Product photographs are as faithful as possible to the items you will receive. However, variations in colour may occur depending on screen settings, lighting conditions, and photography techniques. Such variations cannot engage the liability of Lézard du Jardin.
Article 4 – Orders
Automatic order registration systems are considered proof of the nature, content, and date of the order.
Lézard du Jardin confirms acceptance of the order by email sent to the address provided by the customer. The sale is deemed final only after confirmation of the order.
Lézard du Jardin reserves the right to cancel any order from a customer with whom there is an ongoing dispute regarding the payment of a previous order.
The information provided by the customer when placing the order is binding. In the event of an error in delivery details, the seller shall not be held responsible for the inability to deliver the product.
Article 5 – Prices
Prices are expressed in euros (€).
The price shown in the order confirmation is the final price, inclusive of all taxes (VAT included for mainland France).
Prices include:

commissioning costs where applicable
Article 6 – Payment
The price invoiced to the customer is the price shown on the order confirmation sent by Lézard du Jardin.
Payment must be made in full within 7 days of placing the order. If payment is not received within this period, Lézard du Jardin cannot guarantee product availability.

Lézard du Jardin reserves the right to refuse any order from a customer with whom there is an ongoing dispute.

Cheque payment
Cheque payable to Lézard du Jardin, mentioning customer name and order reference, sent to:

Bank transfer
Transfer details are provided during checkout. Customer must include name and order reference.
PayPal
Payment must be made from the customer’s PayPal account to the PayPal account of Lézard du Jardin, details provided during checkout.
Article 7 – Delivery
After order confirmation, Lézard du Jardin undertakes to deliver the ordered products to its carrier within the timeframes indicated on the product pages.
Delivery is carried out by a carrier to the address provided by the customer. Delivery is available in mainland France only, excluding Corsica and islands not connected by road.
Goods travel at the recipient’s risk. The customer must check the condition of the goods upon delivery before signing the delivery note.
Upon delivery:

Any damage must be clearly noted as handwritten reservations on the delivery note and signed.

The statement “subject to unpacking” has no legal value.

Any damage must also be reported by registered letter to the carrier within 72 working hours, with a copy sent to:

In cases of force majeure (war, riots, fire, strikes, accidents, supply shortages), Lézard du Jardin cannot be held liable for delivery delays or failures.
Article 8 – Right of Withdrawal
In accordance with consumer law, you have 14 days from receipt of the goods to exercise your right of withdrawal.
Returned products must be new, unused, complete, and in their original packaging, suitable for resale.
Withdrawal procedure:

Notify us by email at contact@lezarddujardin.fr within 14 days of receipt

Return the product with tracking within 14 days

Include a letter stating your withdrawal, contact details, and order reference
Return shipping risks and costs remain the responsibility of the customer.
Refunds (excluding delivery costs) will be made within 30 days, subject to compliance with return conditions.
⚠️ Custom-made or made-to-order products
Products manufactured to order require a non-refundable deposit. In case of cancellation, the deposit is forfeited.
Article 9 – Warranty
Products sold on The Garden Arts benefit from a 1-year manufacturer’s warranty covering manufacturing defects or hidden defects from the date of delivery.
Warranty excludes:

abnormal use

product modification
-
accidental damage
-
normal wear and tear
In the event of a defect, contact us at contact@lezarddujardin.fr.
If the defect is confirmed, the warranty provides repair or replacement only.
Shipping costs remain the customer’s responsibility.
Article 10 – Disputes
These Terms and Conditions are governed by French law.
Lézard du Jardin shall not be held liable for damages resulting from misuse of products or modifications made by the customer.
Liability shall in all cases be limited to the amount of the order.
In the event of a dispute, the customer shall first seek an amicable solution with the company.
Failing this, the Commercial Court of Saintes (France) shall have exclusive jurisdiction, regardless of delivery location or payment method.
